Probe Ends in Police Shooting of Man in Wheelchair in Delaware

A new report in Delaware says the police officers who shot and killed a man in a wheelchair were justified to open fire. NBC10’s Tim Furlong tells us the story.

Wilmington police say they have finished criminal and internal investigations into the fatal police shooting of a man in a wheelchair.

Authorities issued a statement Tuesday saying the police department's criminal investigation into the September shooting of Jeremy McDole has concluded, and the results submitted to the attorney general's office, which is conducting its own criminal investigation. The results were not disclosed.

The family of Jeremy McDole, a wheelchair-bound man shot to death by officers in Wilmington in September, is suing the police department, saying deadly force was not necessary. The Delaware Attorney General’s office is investigating. NBC10’s Tim Furlong reports.

The police department's Office of Professional Standards also has completed a separate internal investigation to determine whether officers involved in the shooting complied with departmental rules and regulations governing the use of deadly force.

Tuesday's announcement comes just days after the city asked a federal judge to dismiss a lawsuit filed by McDole's family, arguing that McDole was armed with a gun and that officers acted properly.
