Judge Throws Out Student's Nut Allergy Lawsuit

A federal judge has dismissed a lawsuit that claimed a western Pennsylvania elementary school was wrong to make a boy with a nut allergy sit alone in the cafeteria.

U.S. District Judge Arthur J. Schwab ruled Tuesday that the Fox Chapel Area School District attempted to work with the boy's family to address the issue. The school is just outside Pittsburgh.

The student's parents claimed that the district violated their son's civil rights during the 2010-11 school year by failing to develop a plan to protect him from exposure.

But Schwab says the district came up with four different plans, and the parents rejected all of them.
