A federal judge has cleared the way for a lawsuit to advance against police over the fatal shooting of a 26-year-old Philadelphia man during a 2014 traffic stop.
Philly.com reports the civil rights claims filed by the family of Brandon Tate-Brown were allowed to move forward on Monday, despite several counts being thrown out.
U.S. District Judge Stewart Dalzell denied a request from Tate-Brown's mother to turn the case into a class-action lawsuit.
Tate-Brown was stopped Dec. 15, 2014 by Officers Nicholas Carrelli and Heng Dang on Frankford Avenue. Police say Tate-Brown had a semiautomatic pistol in his car and a struggle ensued, which ended with Tate-Brown being shot to death.
The District Attorney's Office has said it's not going to charge the officers.
